Governing law for purchases on Yenga.eu

Online sales on yenga.be are governed by Belgian law. Any contract for the purchase of goods from this site and any dispute or claim arising out of or in connection with any such contract will be governed by Belgian law. You and we both agree that the courts of Bruges (Belgium) will have exclusive jurisdiction.

Applicability of the “United Nations Convention on Contracts for the International Sale of Goods” (“Vienna Sales Convention”) shall be excluded.

 

What if you change your mind?

Consumer regulations apply which give consumer buyers (but not professional buyers) the right to cancel the purchase within 14 days of receiving the item, except for products made to order: consumers have a minimum of 14 calendar days from the day after the item is received to let sellers know they’d like to return the item for a refund. Consumers then have an additional 14 calendar days from when they let sellers know they want to return the item, to actually return it, or provide proof of the return. Buyers pay return postage.

 

Fallback

Should one or more provisions of these terms be invalid or null and void (or partly so) or be nullified, the remaining provisions shall remain in full force, and the parties shall consult in order to put in place a replacement provision such that the intention and purport of the provision(s) that is/are to be replaced are preserved as far as possible.

 

Ownership:

The risk in the goods shall pass to the customer shall pass at the time of payment

 

Guarantee/Warranty

The warranty period for the goods shall be two (2) years. During said period, Yenga Comm. V. shall make every effort, to the best of its ability, to rectify, free of charge, any material or manufacturing defects within a reasonable period or, if this is not possible, to arrange for a replacement goods. Repair or replacement shall take place only if the defect or malfunction is reported as soon as the customer becomes aware of said defect or malfunction with as much detail as possible.

This warranty shall not apply to damage arising as a result of improper, careless, or abnormal use, wear and tear, negligence, overloading, incorrect installation and/or incorrect assembly by customer or by a third party engaged by customer, or an accident.

When goods are parts that can be assembled as a kit into a full machine, then warranty only extends to the individual parts and not to the assembly or the assembled kit or machine. No warranty is provided for assembly, assembled machines or kits – nor is there any guarantee regarding meeting machine or safety norms for assembly, assembled machines or kits. It is customer’s only responsibility to verify and make sure that assembled machines or kits meet norms.

 

Limitation of liability

Yenga Comm. V. shall not be liable to the customer for loss/harm that is the result of use, which shall include that relating to wear and tear, or of incorrect installation, and/or incorrect assembly of the goods, and any other products supplied by Yenga Comm. V.

Yenga Comm. V. shall not be liable for indirect damage, consequential damage, loss of profits, savings not realised, reduction in good will, loss/harm due to an interruption in business operations, loss/harm ensuing from claims by customer’s own customers, loss/harm caused by the electricity or mechanical force, impairment or loss of data, loss/harm relating to the engagement of suppliers, items, materials or software belonging to third parties or not, except if and in so far as such damage is the result of a deliberate act on the part of Yenga Comm. V.

In all cases in which Yenga Comm. V. is liable to pay damages, such damages shall in no case be higher than either – at Yenga Comm. V. 100% of the invoiced value of the goods and the associated services delivered in connection with which the loss/harm was caused (but with a maximum of EUR 2,000 per occurrence and in the case of multiple occurrences with a total maximum of EUR 3,000).

Yenga Comm. V. shall not be liable for any harm or loss resulting from a defect in the goods and/or devices that do not form part of the goods, or from defects assembled goods or kits, or defects in assembly.a
